Upskillery Healthcare Learning & Inspiration is an online platform, www.upskillerylms.com (the “Site”) provided by Upskillery LLC (“Upskillery”, we or us). UPSKILLERY is an Arkansas limited liability company that exists to provide users of the Site with an education and training resource (“Services”). This privacy policy (“Policy”) describes how Upskillery collects, uses, protects, and shares personal information of users of the Site, whether as a viewer of the site or a registered user of the Services.

Upskillery understands how important privacy is to you and we are committed to creating a safe environment for learners of all ages.
WHAT WE COLLECT & HOW WE USE IT
We respect your information and our goal is to collect as little personal information as possible while still providing a quality service to you and your institution. We receive and store information about individuals in a range of ways.
Information You Give Us. The majority of the information we collect is when an account is created, either by you or by your institution or organization when they create an account for you. The section below discusses that information.
We do collect information from accessing our Site, like when you fill out forms on our Site. The information we collect from you is used to potentially provide the Service to you and to fulfill any obligations from us or you in regards to the Service. This information includes records and copies of your correspondence with us and details of any transactions with us.
Information from Other Users. When Upskillery enters into a contract with organizations to provide the Service, we collect information, including personal information, when your institution or organization creates an account to subscribe to our Services, to help us identify you, including your name, your email address, your location, and potentially your employee identification number.
The information we collect from others is used to provide the Service to you and to fulfill our obligations to you or your institution or organization in regards to the Service. Specifically, that includes your records, providing customer service, communicating with you about your account, and to enforce compliance with our Terms of Use and applicable laws.
Information Automatically Collected. We automatically log information about you and your computer. For example, when visiting our Site, we log IP address, date and time of access, location information, browser information, operating system information, and information about your use of and actions on our Site. While you use our site, we also collect information related to how you interact with us, such as your path through our Site or how long you interact with our Site. This information allows us to update our services and learn how we can better equip the Site to serve you.
Upskillery uses this information in the following ways:
Your institution or organization decides how we use the information we collect. By providing our services to your organization or institution, we primarily use the information we collect to provide feedback and reporting. This includes:
- How you use the Site, like what pathways you use within the Site;
- What you look at on the Site, including which learning objectives you view and/or complete; and
- What learning objects you complete on the Site, including your scores.
In addition to providing this feedback to your organization or institution, we may use the information we collect in the following ways:
To provide and enhance our Service. We provide our Services to end users of institutions and organizations as a data processor for those entities. We use your information on behalf of and under the instruction of your institution or organization to operate, maintain, enhance, and provide all of the features of our Services.
To personalize your experience. We use the information to personalize your experience while using the Services. For instance, Upskillery remembers your recent activity so we can recommend the most appropriate content for you on your next visit and provide personalized learning experiences.
To communicate with you. We use your information to communicate with you about your account and respond to inquiries.
To understand, improve, and develop our Services. Upskillery uses all of the information that you provide or that we collect from users to understand and analyze the usage trends, learning behaviors, and preferences of our users, to improve the way the Services work and look, to generate statistics, develop marketing plans and to create new features and functionality. When we use information for these purposes, we implement appropriate safeguards, including removing your personal identifiers like your name.
SHARING OF PERSONAL INFORMATION
The goal of Upskillery is to provide a learning management system to provide educational content to the users of the Site. Protection of your personal information is important to us. We do not sell or trade your personal information with others.
We do not share personal information with third parties for users of the site that do not have an account with Upskillery for Services. If you have an account to access the Services, we may share information with institutions or organizations as follows:
- We share your information in accordance with our agreement with your organization or institution. Generally, this means we will share much of the personal information with your institution or organization. The information shared depends on the institution and organization.
- We share information about your use of the Site in accordance with our agreement with your institution. The information shared depends on the institution and normally includes your progress for learning objectives.
- We may share personal information for legal, protection, and safety purposes.
- We may share information to comply with laws.
- We may share information to respond to lawful requests and legal processes.
- We may share information to protect the rights and property of Upskillery, our agents, customers, and others. This includes enforcing our agreements, policies, and terms of use.
- We may share information to a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Upskillery’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by Upskillery about our Users is among the assets transferred.
- We may share information in an emergency. This includes protecting the safety of our employees and agents, our customers, or any person.
INFORMATION CHOICES AND CHANGES

STORAGE OF INFORMATION
Your information collected through the Site is processed in the United States. If you are based in the United States and use our Site, you consent to have your information processed by Upskillery in the United States. International clients have differing needs based on their country of origin and we provide custom storage and processing solutions to meet those requirements.
The security of your information is important to us. We use commercially reasonable technical and organizational safeguards to protect your information from unauthorized use, disclosure, and loss.
We encourage you to take reasonable measures to protect your password and your computer to prevent unauthorized access to your account. Data transmission over the Internet, mobile networks, wireless transmission, or electronic storage of information is a risk and cannot be 100% secure. As a result, we cannot guarantee or warrant the security of any information you transmit to or from our Site, and you provide us with your information at your own risk.
CHILDREN
Upskillery does not permit children under the age of 13 to create an account. Please contact us at support@upskillerylms.com if you believe we have inadvertently collected personal information from a child under 13 so that we may delete the information as soon as possible.

USERS FROM OUTSIDE OF THE UNITED STATES
The Site is hosted in the United States. This PRIVACY NOTICE FOR CALIFORNIA RESIDENTS supplements the Privacy Policy of Upskillery LLC (“Upskillery”) and applies solely to visitors, users and others who reside in the State of California (“you”) when you visit the Upskillery website, www.upskillerylms.com (the “Site”) or register for an account with the Site. Your institution or organization decides how we use the information we collect. By providing our services to your organization or institution, we primarily use the information we collect to provide feedback and reporting to that entity to fulfill our obligations to your educational institution or your employer. This includes:
- How you use the Site, like what pathways you use within the Site;
- What you look at on the Site, including which learning objects you view and/or complete; and
- What learning objects you complete on the Site, including your scores.
In addition to providing feedback and reporting, we may use or disclose the personal information we collect for one or more of the following business purposes:
- To improve our Site.
- As necessary or appropriate to protect the rights, property or safety of us, our customers or others.
- To respond to law enforcement requests and as required by applicable law, court order, or governmental regulations.

Sharing Personal Information

When we disclose personal information for a business purpose, we enter a contract that describes the purpose and requires the recipient to both keep that personal information confidential and not use it for any purpose except performing the contract.

In the preceding twelve (12) months, we have not sold any personal information.
Your Rights and Choices
California residents have the right to request that Upskillery disclose what personal information it collects, uses, discloses or sells. Once we receive and confirm your verifiable consumer request, we will disclose to you:
- The categories of personal information we collected about you.
- Our business or commercial purpose for collecting that personal information.
- The categories of third parties with whom we share that personal information.
- The specific pieces of personal information we collected about you (also called a data portability request).
Upskillery does not sell your personal information to third parties. However, under some circumstances a transfer of personal information to a third party without monetary consideration may be considered a “sale” under California law. If you submit a request to stop selling your personal information, we will stop making such transfers. Deletion Request Rights
California residents also have the right to request the deletion of their personal information collected or maintained by Upskillery. If you wish to make a request for information or to delete your personal information, or for any questions about our privacy practices and compliance with California law, please contact the organization or institution that created your Upskillery account on your behalf to exercise your rights. We will work with your organization as needed.
